Lancashire pensioner who suffered from mouth pain for ten years has won £18k payout

A pensioner who suffered mouth pain for ten years has won an £18,000 payout – after he was told his painful dental work should never have been carried out.

James Clay, 70, endured years of painful fitting and re-fitting of bridges, unnecessary extraction of teeth, gum disease and even bone loss after visiting Dr Roger Hughlock’s surgery in 2003.

The retired engineer of Darwen, Lancashire, suffered severe pain as a result, and had to miss special occasions such as his grandson’s christening and have several extra procedures.

Mr Clay first visited Dr Hughlock’s surgery after struggling to eat with his dentures and was told by the dentist that he needed significant and expensive restorative work. 

When he later saw a different dentist for a second opinion, he was told that the work should not have been done in the first place because he was suffering with gum disease.

He then instructed The Dental Law Partnership and was awarded £18,000 in an out-of-court settlement from Dr Hughlock, of Lowerbank Dental Practice in Leyland, Lancashire.

Mr Clay said: ‘The last decade of my life has been one of dental pain.

‘All I wanted when I retired was a peaceful life and a chance to spend time with my family.

‘I haven’t been able to enjoy some very special occasions – I wasn’t able to go to my grandson’s christening because I was in so much pain.’

Dr Hughlock did not admit liability and declined to comment, other than to say ‘There was no negligence and it has been settled.’

James has been told that he has suffered bone loss as a result of untreated gum disease and would likely need future extractions of implants, bone grafting, and implants.

X-rays have since shown the implants were placed too close together and the others were already showing signs of failure when the bridge was cemented into place.
